“I had gone to bed by the time he returned. He came to my room crying and telling me he was sorry.”

Businesswoman Monicah Kimani hit the headlines when her body was discovered dumped in her bathtub in her posh apartment in Kilimani.

Jowie was denied bail by Justice James Wakiaga.

In his ruling, Justice revealed that Monicah’s family opposed Jowie’s bail application in an affidavit sworn by George Kimani, Monicah’s small brother.

Part of the reasons read:

“The fact that the motive of the murder of the deceased is unknown poses a greater danger to them since they are not sure whether it was against the family with the deceased being the first victim,” adding, “The manner and style in which the deceased was murdered shows that the people who did it are meticulously organized and dangerous individuals whom if given a chance are capable of ensuring that the entire case collapses.”

George added in the affidavit

“The accused persons tried to conceal some of the evidence before their arrest and that the police are still searching for one other person who was allegedly with the 1st accused, the murder weapon, the deceased house and car keys and if released on bond they will interfere with the ongoing investigations.”

Justice Wakiaga added that George knew Jowie “who was his college mate at Kenya Polytechnic.”

Jacque Maribe granted bail, as fiancé Jowie to stay in custody

Jacque Maribe and her fiancé Joseph Irungu alias Jowie today appeared before Justice James Wakiaga for the hearing of their bail application.

The TV presenter was granted bail, weeks after she was arrested. Making the judgement Justice James Wakiaga ruled that Jacque Maribe should be released on a Ksh 2 million bond with 1 surety of the same amount.

The other option was a cash bail of Ksh 1 million with 3 sureties of the same amount.

The bail comes with a few conditions among them being that

1. Jacque Maribe cannot report news during this whole period.

2. She cannot discuss the issue, or be invited to interviews to discuss Monicah Kimani’s murder.

3. She can’t meet anyone related to Monicah Kimani either direct or indirectly.

4. Accompany her advocate to her house and allow the investigating officer to take any photographic evidence, if he is not done with investigations before she is allowed into the house.

5. Cannot interview anyone involved in the case either directly or indirectly.

In the previous hearing, lead prosecutor Catherine Mwaniki, was opposed to the release of the two on bail or bond saying that they have been charged with a capital offence.

Initially the Prosecution was against Maribe’s return to news-anchoring, saying should she be allowed to broadcast news, she would likely “intimidate” the witnesses.

 Read the judge’s opinion below

“Should we order that she shouldn’t be allowed to anchor news on TV, and her employer insists that that was what she was hired to do, and since she can’t do it due to a court order, she gets laid off, who would we blame for that?” posed Justice Wakiaga.

The Prosecution further argued that while investigations are still underway they have already identified the key witnesses whom they say could be influenced by the accused persons.

In their submission, the Prosecution termed Jowie as a flight risk since his nature of work indicates that he has travelled to the Middle East countries on a regular basis.

They further told the court that Jowie has not been cooperating with the police and the information he has given is not true.

Exposed! Here is why Jacque Maribe’s fiancé Jowie stole ‘mtu wa mjengo’s ID

New details have emerged on where Jacque Maribe’s fiancé Joseph Irungu alias Jowie might have ‘stolen’ an ID to go commit the murder of Monicah Kimani.

When he was arrested on the 25th September 2018, police discovered that he had registered himself as Dominic with the security personnel at the gate of where Monicah Kimani lived in Kilimani.

Here are all the plans slain Kilimani woman Monicah Nyawira had for her birthday before her gruesome murder

The national Identity Card murder suspect Jowie Irungu used to gain access to Monica Kimani’s apartment had been reported missing two days earlier.

The ID card belongs to Dominic Bisela, a casual worker at a construction site within Royal Park apartments where Jowie and his television journalist girlfriend, Jacque Maribe, live in Lang’ata estate, Nairobi.

The ID card went missing on September 17, two days before Monica was found with her throat slit at her Lamuria Gardens pad off Dennis Pritt Road, Nairobi.

Police are still holding Jowie as the prime suspect in the murder and Maribe as an “accessory to the murder” of Monica Kimani.

Directorate of Criminal Investigations (DCI) boss George Kinoti told The Nairobian that Bisela’s ID card was reported missing from the sentry box where other identification cards were left by construction workers.

Kinoti explained that Bisela,

“did not find his ID in the evening after completing duty at the construction site. He informed the guard to be on the lookout for the card just in case it had been misplaced from the rest of the IDs.”

Here are reasons why Jowie opted to ‘steal’ the mans identity card

1. The stolen ID would be easy to dispose and it would be hard to track him down.

2. Revenge Motive

In some cases, the motivation for identity theft is more personal than financial. Jilted lovers, former friends, bickering business partners and even family members can use identity theft to shatter the lives of those they feel have wronged them

3. Concealment of Other Crimes

Some identity thieves use their stolen information as a tool to commit even bigger crimes. They may cover their tracks by implicating the true owner of the stolen identity in their crimes.

Why Jacque Maribe and Jowie have to stay longer in remands after being charged afresh for murder

Jacque Maribe and her fiancé Joseph Irungu appeared in court before Justice James Wakiaga for the hearing of their bail case

4.He is a dangerous person for the fact that he owns a gun .

Maribe and Jowie are accused of murdering Monica at an apartment along Dennis Pritt Road.

The slain businesswoman’s body was found deposited in a bathtub, throat slashed and hands tied to the back.

Jowie was arrested on September 25, being four days after the woman’s body was found.

Maribe and her fiance will remain in custody until Wednesday when the case will be mentioned.

They had applied for bail but Lessit said the application will be heard by a different court.

The defence lawyers argued that the two have been in police custody for 15 days, hence, it would be improper to detain them further.

Katwa Kigen, appearing for Maribe, had asked the court to compel the prosecution to serve them with investigation file exhibits and statements from witnesses.

But the prosecution lawyers, saying they are not opposed to the bid for bail, sought two weeks to conclude their investigations.

For the first time, Jowies mum has appeared in public to support her son  after much criticism that his family members did not show him support.

The two were seen embracing in a tight hug leaving Jowie in tears.

Jacque Maribe and her fiancee Joseph Irungu alias Jowie have been in the news after being charged for the murder of Monicah Kimani .

What most people have not pictured is the seriousness of the charge the duo have been charged with and what they stand to lose in case they get sentenced.

Jacque and Jowie could be sentenced to death if the prosecution can prove beyond a reasonable doubt that she is guilty of murder.

Director of Public Prosecutions Noordin Haji ordered Maribe and her fiancé Joseph Irungu, popularly known as Jowie, to be charged with the murder of businesswoman Monica Kimani.

Judge Lesiit orders Jacque Maribe to be taken to Mathari Hospital for mental assessment

Monica was found with her hands and legs tied, mouth gagged and throat slashed. Her body was deposited in a bathtub at her apartment in Kilimani, Nairobi.

Maribe and Irungu were arrested in connection with the killing, hence, their arraignment on Tuesday.

What does the law say about murder?

The law states that any person who conspires with any other person to kill any person, whether that person is in Kenya or elsewhere, is guilty of a felony and is liable to imprisonment for14 years.

The law also states that any person who counsels or procures another person to commit the offense may be charged with the same offence.

A conviction of counselling or procuring the commission of murder attracts the same consequences as a conviction for the offense.

Once convicted of murder, a person is sentenced to death by hanging.

A conviction requires the prosecution to establish the intent to cause death and knowledge that his or her action or inaction will cause death, among other things.

Section 204 of the Penal Code states that anyone found guilty of murder, robbery with violence, treason and other capital offences shall be hanged.

Last week, the High Court found journalist Moses Otieno Dola guilty of manslaughter for causing the death of his wife Wambui Kabiru.
