High Court Judge Esther Maina ordered the money to be forfeited after failing to explain the source of the money or why it was kept in sacks at her home instead of being deposited in a bank.

Nancy Indoveria Kigunzi, popularly known as Mathe Wa Ngara, lost Sh13.4 million found at her home during a raid last year after the court declared it proceeds of crime.

High Court Judge Esther Maina ordered the money to be forfeited after failing to explain the source of the money or why it was kept in sacks at her home instead of being deposited in a bank.

The magistrate added that there was evidence that the police found something at the residence, which later turned out to be marijuana, a narcotic drug, for possession, use, and illegal trade, which is a crime.

"It is also undisputed that the police found three people at the residence under circumstances suggesting that they were mules used to transport the illegal drug," the magistrate said.

Judge Maina said she was satisfied that there was evidence on a balance of probabilities that the money was directly linked to criminal activities, although a commission or otherwise regarding the offense has not yet been decided.

"An order is hereby made declaring that the total sum of Kenya Shillings 13,474,520 found at the residence of the Respondent but deposited at the Central Bank of Kenya is proceeds of crime and therefore liable to be forfeited to the Government of Kenya," the magistrate said.
