A man who threw his girlfriend from the 12th floor to the ninth floor after meeting on Facebook has been sentenced to five years imprisonment. 

Milimani principal magistrate Esther Kimilu convicted Moses Njoroge after the court found him guilty of causing grievous bodily harm to the woman.

"I note the mandatory sentence is life imprisonment but due to the remorsefulness of the accused and the commitment to change, has persuaded me to jail him to five years in prison," the magistrate ruled.

The court did not give an option of a fine. The magistrate said that the victim is still undergoing treatment two years since the incident occurred.

She said she had considered the accused person was committed to rehabilitation due to alcoholism and anger issues according to the report.

Njoroge was charged with causing grievous bodily harm to his girlfriend on September 13, 2020.

On November 17, the magistrate convicted Njoroge having found that he had no reasons or justification to assist the woman, saying he was not remorseful even after committing the offence.

The court said from the evidence, the victim did not show any suicidal thoughts.

The magistrate ruled that evidence adduced before the court and all the essential ingredients of the offence of grievous harm had been proved beyond a reasonable doubt.

“I hereby pass a verdict of guilty and convict the accused person,” the magistrate ruled.

In his mitigation, Njoroge said he was a first offender and prayed for a lenient sentence. 

In March, the woman narrated to the court how her boyfriend threw her from the 12th to the 9th floor in a city building.

She told the court that Njoroge had invited her to Ambank House 12th floor.

The victim who spent two months at KNH for treatment told the court that on September 13, 2020, she had travelled from her home in Karura to Nairobi CBD to meet her boyfriend.

She had told her mother that she was going to meet her boyfriend in Nairobi.

When she arrived in the CBD, she called Njoroge who told her to go see him in his office at Ambank House.

She said the accused picked her up at Ambank House reception and took her to the 12th floor where they spent some time before going out to get lunch.

They went out and bought two pieces of chicken and chips and then proceeded to a supermarket, where they bought whisky and soda before heading back to the office.

They enjoyed the drinks until 7:30 pm when the woman decided to leave.

Njoroge allegedly was not happy with the idea of her leaving as he wanted to spend the night with her.

They allegedly started arguing and fighting and in the process, the woman fell through the window.

She was injured on the pelvis and taken to KNH for treatment.

John Kitavi, head of security at the Ambank building said the woman asked for help after the incident.

“The accused came to me saying that a woman who had fallen was screaming for help and is in pain,” Kitavi said.

He said when asked who had thrown her off the veranda, the woman said it was her boyfriend but asked Kitavi not to touch him.
